체약국은 집단살해는 국제연합의 정신과 목적에 반하며 또한 문명세계에서 죄악으로 단정한 국제법상의 범죄라고 국제연합 총회가 1947년 12월 11일부 결의 96(1)에서 행한 선언을 고려하고, 역사상의 모든 시기에서 집단살해가 인류에게 막대한 손실을 끼쳤음을 인지하고,
인류를 이와 같은 고뇌로부터 해방시키기 위하여는 국제협력이 필요함을 확신하고,


이에 하기에 규정된 바와 같이 동의한다.


제1조 체약국은 집단살해가 평시에 행하여졌든가 전시에 행하여졌든가를 불문하고 이것을 방지하고 처벌할 것을 약속하는 국제법상의 범죄임을 확인한다.

제2조 본 협약에서 집단살해라 함은 국민적, 인종적, 민족적 또는 종교적 집단을 전부 또는 일부 파괴할 의도로서 행하여진 아래의 행위를 말한다.
(a) 집단구성원을 살해하는 것
(b) 집단구성원에 대하여 중대한 육체적 또는 정신적인 위해를 가하는 것
(c) 전부 또는 부분적으로 육체적 파괴를 초래할 목적으로 의도된 생활조건을 집단에게 고의로 과하는 것
(d) 집단 내에 있어서의 출생을 방지하기 위하여 의도된 조치를 과하는 것
(e) 집단의 아동을 강제적으로 타 집단에 이동시키는 것

제3조 다음의 제 행위는 이를 처벌한다.
(a) 집단살해
(b) 집단살해를 범하기 위한 공모
(c) 집단살해를 범하기 위한 직접 또는 공연한 교사
(d) 집단살해의 미수
(e) 집단살해의 공범

제4조 집단살해 또는 제3조에 열거된 기타 행위의 어떤 것이라도 이를 범하는 자는 헌법상으로 책임있는 통치자이거나 공무원 또는 사인이거나를 불문하고 처벌한다.

제5조 체약국은 각자의 헌법에 따라서 본 협약의 규정을 실시하기 위하여 특히 집단살해 또는 제3조에 열거된 기타의 행위의 어떤 것에 대하여도 죄가 있는 자에 대한 유효한 형벌을 규정하기 위하여 필요한 입법을 제정할 것을 약속한다.

제6조 집단살해 또는 제3조에 열거된 기타 행위의 어떤 것이라도 이로 인하여 고소된 자는 행위가 그 영토 내에서 범행된 국가의 당해재판소에 의하여 또는 국제형사재판소의 관할권을 수락하는 체약국에 관하여 관할권을 가지는 동재판소에 의하여 심리된다.

제7조 집단살해 또는 제3조에 열거된 기타 행위는 범죄인 인도의 목적으로 정치적 범죄로 인정치 않는다. 체약국은 이러한 경우에 실시 중인 법률 또는 조약에 따라서 범죄인 인도를 허가할 것을 서약한다.

제8조 체약국은 국제연합의 당해 기관이 집단살해 또는 제3조에 열거한 기타 행위의 어떤 것이라도 이를 방지 또는 억압하기 위하여 적당하다고 인정하는 국제연합 헌장에 기한 조치를 취하도록 요구할 수 있다.

제9조 본 협약의 해석 적용 또는 이행에 관한 체약국간의 분쟁은 집단살해 또는 제3조에 열거된 기타 행위의 어떤 것이라도 이에 대한 국가책임에 관한 분쟁을 포함하여 분쟁 당사국 요구에 의하여 국제사법재판소에 부탁한다.

제10조 본 협약은 중국어, 영어, 불어, 노어, 서반아어의 원문을 동등히 정문으로 하며 1948년 12월 9일자로 한다.

제11조 본 협약은 국제연합의 가맹국과 총회로부터 서명 초청을 받은 비가맹국을 위하여 1949년 12월 31일까지 개방된다. 본 협약은 비준을 받아야 한다. 비준서는 국제연합 사무총장에게 기탁한다. 1950년 1월 1일 이후 본 협약은 국제연합의 가맹국과 전기한 초청을 받은 비가맹국을 위하여 가입되어질 수 있다. 가입서는 국제연합 사무총장에게 기탁한다.

제12조 체약국은 국제연합 사무총장 앞으로의 통고로써 자국이 외교관계의 수행에 책임을 지고 있는 지역의 전부 또는 일부에 대하여 하시라도 본 협약의 적용을 확장할 수 있다.

제13조 최초의 20통의 비준서 또는 가입서가 기탁된 일자에 사무총장은 경위서를 작성하여 그 사본을 국제연합의 각 가맹국과 제11조에 규정된 비가맹 각국에 송부한다. 본 협약은 20통째의 비준서 또는 가입서가 기탁된 90일 후에 발효한다. 전기일 이후에 행하여진 비준이나 가입은 비준서 또는 가입서 기탁 90일 후에 효력을 발생한다.

제14조 본 협약은 발효일로부터 10년간 계속하여 효력을 갖는다. 전기 기간의 적어도 만료 6개월 전에 본 조약을 폐기하지 아니한 체약국에 대하여는 본 협약은 그 후 5년간씩 계속하여 효력을 가진다. 폐기는 국제연합 사무총장 앞으로의 통고서에 의하여 행한다.

제15조 폐기의 결과 본 협약에의 가맹국수가 16 이하일 때에는 본 협약은 폐기의 최후의 것이 효력이 발생하는 날로부터 효력이 종지된다.

제16조 본 협약의 개정요청은 체약국이 사무총장 앞으로의 통고서에 의하여 언제나 행할 수 있다. 총회는 전기 요청에 관하여 취한 조치가 있을 때에는 이를 결정한다.

제17조 국제연합 사무총장은 국제연합의 모든 가맹국과 제11조에 규정된 비가맹국에 대하여 다음 사항을 통고한다.
(a) 제11조에 의하여 수령한 서명 비준 또는 가입
(b) 제12조에 의하여 수령한 통고
(c) 제13조에 의하여 본 협약이 발효하는 일자
(d) 제14조에 의하여 수령한 폐기
(e) 제15조에 의한 협약의 폐지
(f) 제16조에 의하여 수령한 통고

제18조 본 협약의 원안은 국제연합의 문서보관소에 기탁한다. 본 협약의 인증등본은 국제연합의 모든 가맹국과 제11조에 규정된 비가맹국에 송부한다.

제19조 본 협약은 발효일자에 국제연합 사무총장이 등록한다.


Convention on the Prevention and Punishment of
the Crime of Genocide


The Contracting Parties,
Having considered the declaration made by the General Assembly of the United Nations in its resolution 96 (I) dated 11 December 1946 that genocide is a crime under international law, contrary to the spirit and aims of the United Nations and condemned by the civilized world,
Recognizing that at all periods of history genocide has inflicted great losses on humanity, and
Being convinced that, in order to liberate mankind from such an odious scourge, international co-operation is required,
Hereby agree as hereinafter provided:


Article 1

The Contracting Parties confirm that genocide, whether committed in time of peace or in time of war, is a crime under international law which they undertake to prevent and to punish.
Article 2

In the present Convention, genocide means any of the following acts committed with intent to destroy, in whole or in part, a national, ethnical, racial or religious group, as such:
(a) Killing members of the group;
(b) Causing serious bodily or mental harm to members of the group;
(c) Deliberately inflicting on the group conditions of life calculated to bring about its physical destruction in whole or in part;
(d) Imposing measures intended to prevent births within the group;
(e) Forcibly transferring children of the group to another group.
Article 3

The following acts shall be punishable:
(a) Genocide;
(b) Conspiracy to commit genocide;
(c) Direct and public incitement to commit genocide;
(d) Attempt to commit genocide;
(e) Complicity in genocide.
Article 4

Persons committing genocide or any of the other acts enumerated in article III shall be punished, whether they are constitutionally responsible rulers, public officials or private individuals.
Article 5

The Contracting Parties undertake to enact, in accordance with their respective Constitutions, the necessary legislation to give effect to the provisions of the present Convention, and, in particular, to provide effective penalties for persons guilty of genocide or any of the other acts enumerated in article III.
Article 6

Persons charged with genocide or any of the other acts enumerated in article III shall be tried by a competent tribunal of the State in the territory of which the act was committed, or by such international penal tribunal as may have jurisdiction with respect to those Contracting Parties which shall have accepted its jurisdiction.
Article 7

Genocide and the other acts enumerated in article III shall not be considered as political crimes for the purpose of extradition.
The Contracting Parties pledge themselves in such cases to grant extradition in accordance with their laws and treaties in force.
Article 8

Any Contracting Party may call upon the competent organs of the United Nations to take such action under the Charter of the United Nations as they consider appropriate for the prevention and suppression of acts of genocide or any of the other acts enumerated in article III.
Article 9

Disputes between the Contracting Parties relating to the interpretation, application or fulfilment of the present Convention, including those relating to the responsibility of a State for genocide or for any of the other acts enumerated in article III, shall be submitted to the International Court of Justice at the request of any of the parties to the dispute.
Article 10

The present Convention, of which the Chinese, English, French, Russian and Spanish texts are equally authentic, shall bear the date of 9 December 1948.
Article 11

The present Convention shall be open until 31 December 1949 for signature on behalf of any Member of the United Nations and of any nonmember State to which an invitation to sign has been addressed by the General Assembly.
The present Convention shall be ratified, and the instruments of ratification shall be deposited with the Secretary-General of the United Nations.
After 1 January 1950, the present Convention may be acceded to on behalf of any Member of the United Nations and of any non-member State which has received an invitation as aforesaid. Instruments of accession shall be deposited with the Secretary-General of the United Nations.
Article 12

Any Contracting Party may at any time, by notification addressed to the Secretary-General of the United Nations, extend the application of the present Convention to all or any of the territories for the conduct of whose foreign relations that Contracting Party is responsible.
Article 13

On the day when the first twenty instruments of ratification or accession have been deposited, the Secretary-General shall draw up a proces-verbal and transmit a copy thereof to each Member of the United Nations and to each of the non-member States contemplated in article 11.
The present Convention shall come into force on the ninetieth day following the date of deposit of the twentieth instrument of ratification or accession.
Any ratification or accession effected, subsequent to the latter date shall become effective on the ninetieth day following the deposit of the instrument of ratification or accession.
Article 14

The present Convention shall remain in effect for a period of ten years as from the date of its coming into force.
It shall thereafter remain in force for successive periods of five years for such Contracting Parties as have not denounced it at least six months before the expiration of the current period.
Denunciation shall be effected by a written notification addressed to the Secretary-General of the United Nations.
Article 15

If, as a result of denunciations, the number of Parties to the present Convention should become less than sixteen, the Convention shall cease to be in force as from the date on which the last of these denunciations shall become effective.
Article 16
A request for the revision of the present Convention may be made at any time by any Contracting Party by means of a notification in writing addressed to the Secretary-General.
The General Assembly shall decide upon the steps, if any, to be taken in respect of such request.
Article 17

The Secretary-General of the United Nations shall notify all Members of the United Nations and the non-member States contemplated in article XI of the following:
(a) Signatures, ratifications and accessions received in accordance with article 11;
(b) Notifications received in accordance with article 12;
(c) The date upon which the present Convention comes into force in accordance with article 13;
(d) Denunciations received in accordance with article 14;
(e) The abrogation of the Convention in accordance with article 15;
(f) Notifications received in accordance with article 16.
Article 18

The original of the present Convention shall be deposited in the archives of the United Nations.
A certified copy of the Convention shall be transmitted to each Member of the United Nations and to each of the non-member States contemplated in article XI.
Article 19

The present Convention shall be registered by the Secretary-General of the United Nations on the date of its coming into force.
